Ex-NY Times publisher Arthur Ochs Sulzberger dies - KWQC-TV6 ...

NEW YORK (AP) - Few moments in American journalism loom larger than the one that came in 1971, when New York Times publisher Arthur Ochs Sulzberger had to decide whether to defy a president, and risk a potential criminal charge, by publishing a classified Defense Department history of U.S. involvement in Vietnam.

His choice, to publish the Pentagon Papers and then fight the Nixon administration's subsequent attempt to muzzle the story, cemented Sulzberger's place as a First Amendment giant - a role being celebrated after he died Saturday at age 86.

The former publisher, who led the Times to new levels of influence and profit while standing up for press freedom, died at his home in Southampton, N.Y., after a long illness, his family announced.

During his three-decade tenure, Sulzberger's newspaper won 31 Pulitzer prizes while he went about transforming the family business from perpetually shaky to the muscular media behemoth it was when he retired.

Weekday circulation climbed from 714,000 when Sulzberger became publisher in 1963 to 1.1 million when he stepped down as publisher in 1992. Over the same period, the annual revenues of the Times' corporate parent rose from $100 million to $1.7 billion.

Yet it was Sulzberger's positions on editorial independence that made him a hero of the profession, like when he rejected his own lawyers' warnings that even reading the Pentagon Papers, let alone publishing them, constituted a crime.

Sulzberger, who went by the nickname "Punch" and served with the Marine Corps, privately worried that he had doomed the newspaper but gave interviews saying the Times wouldn't allow the U.S. government to cover up its mistakes under the guise of national security.

"That is a wonderful way, if you've got egg on your face, to prevent anybody from knowing it: Stamp it SECRET and put it away," he said.

"Punch, the old Marine captain who never backed down from a fight, was an absolutely fierce defender of the freedom of the press," his son, and current Times publisher, Arthur Ochs Sulzberger Jr., said in a statement.

Sulzberger was the only grandson of Adolph S. Ochs (pronounced ox), the son of Bavarian immigrants who took over the Times in 1896 and built it into the nation's most influential newspaper.

The family retains control to this day, holding a special class of shares that give them more powerful voting rights than other stockholders.

Power was thrust on Sulzberger at the age of 37 after the sudden death of his brother-in-law in 1963. He had been in the Times executive suite for eight years in a role he later described as "vice president in charge of nothing."

But Sulzberger directed the Times' evolution from an encyclopedic paper of record to a more reader-friendly product that reached into the suburbs and across the nation.

Under his watch, the Times started a national edition, bought its first color presses, and introduced - to the chagrin of some hard-news purists - popular and lucrative sections covering topics such as food and entertainment.

"You forget the unbelievable outrage that greeted those sections. But in retrospect it was the right decision both editorially and economically," said Nicholas Lemann, dean of the Columbia University Graduate School of Journalism.

In 1992, Sulzberger relinquished the publisher's job to his son but remained chairman of The New York Times Co. Sulzberger retired as chairman and chief executive of the company in 1997. His son then was named chairman. Sulzberger stayed on the Times Co. board of directors until 2002.

Reacting to news of Sulzberger's death Saturday, former Times executive editor Joseph Lelyveld said that his business success was matched by integrity in the newsroom.

"As an editor, you knew that if you went to the publisher and sought his support on an issue that you deemed to be of high importance, you could pretty much count on getting it. He knew how to back his people," Lelyveld said.

President Barack Obama said Sulzberger was "a firm believer in the importance of a free and independent press - one that isn't afraid to seek the truth, hold those in power accountable, and tell the stories that need to be told."

New York Gov. Andrew Cuomo said he "changed the course of American history with his journalistic decisions."

Significant free-press and free-speech precedents were established during Sulzberger's years as publisher, most notably the Times vs. Sullivan case. It resulted in a landmark 1964 Supreme Court ruling that shielded the press from libel lawsuits by public officials unless they could prove actual malice.

"Punch Sulzberger was a giant in the industry, a leader who fought to preserve the vital role of a free press in society and championed journalism executed at the highest level," said Associated Press President and CEO Gary Pruitt. "The Associated Press benefited from his wisdom, both during his years on the board of directors and his thoughtful engagement in the years that followed."

In 1971, the Times led the First Amendment fight to keep the government from suppressing the Pentagon Papers.

Sulzberger read more than 7,000 pages of the documents and presided over a dramatic internal debate before deciding to publish. Then, he resisted a demand by Attorney General John Mitchell that the paper halt the series after two installments.

A federal judge delayed publication of additional installments, but in a landmark decision, the U.S. Supreme Court eventually sided with the Times and The Washington Post, and allowed the series to continue.

"There were those that thought some kind of deal or reconciliation with the government should have been sought," said First Amendment lawyer Floyd Abrams, who represented the Times in the court case. "It was Punch Sulzberger who made the decision to resist the government's effort. In making that decision he set in motion a litigation which not only preserved but protected the First Amendment for generations."

In their book "The Trust," a history of the Ochs-Sulzberger family and its stewardship of the paper, Susan E. Tifft and Alex S. Jones cited Sulzberger's "common sense and unerring instincts."

In an interview in 1990 with New York magazine, Sulzberger was typically candid about the paper's readership.

"We're not New York's hometown newspaper," he said. "We're read on Park Avenue, but we don't do well in Chinatown or the east Bronx. We have to approach journalism differently than, say, the Sarasota Herald Tribune, where you try to blanket the community."

Sulzberger was born in New York City on Feb. 5, 1926, the only son of Arthur Hays Sulzberger and his wife, Iphigene Ochs Sulzberger, Adolph's only child. One of his three sisters was named Judy, and from early on he was known as "Punch," from the puppet characters Punch and Judy.

Sulzberger's grandfather led the paper until his death in 1935, when he was followed by Sulzberger's father, who remained at the helm until he retired in 1961.

Except for a year at The Milwaukee Journal, 1953-54, the younger Sulzberger spent his entire career at the family paper after graduating from Columbia College in 1951. He worked in European bureaus for a time and was back in New York by 1955, but found he had little to do.

At various times, Sulzberger was a director or chairman of the Newspaper Advertising Bureau, American Newspaper Publishers Association and American Press Institute. He was a director of The Associated Press from 1975 to 1984.

Sulzberger married Barbara Grant in 1948, and the couple had two children, Arthur Jr. and Karen. After a divorce in 1956, Sulzberger married Carol Fox. The couple had a daughter, Cynthia, and Sulzberger adopted Fox's daughter from a previous marriage, Cathy.

Carol Sulzberger died in 1995. The following year, Sulzberger married Allison Cowles, the widow of William H. Cowles 3rd, who was the president and publisher of The Spokesman-Review and Spokane Chronicle of Spokane, Wash. She died in 2010.

Officials: Terror groups in Libya tried to unite in month leading to attack

Intelligence indicates that militant or terrorist groups were attempting to combine forces in the month preceding the attack on the U.S. consulate in Benghazi, Libya, that killed Ambassador Chris Stevens, the chairman of the Joint Chiefs of Staff said Thursday.

"There was a thread of intelligence that groups in that environment in eastern Libya were seeking to coalesce," Gen. Martin Dempsey said in a briefing to Pentagon reporters,?adding that there was nothing specific in the intelligence that indicated an attack on the U.S. consulate was imminent.?

Dempsey said the intelligence was widely shared with all U.S. departments and agencies.


Defense Secretary Leon Panetta added that the assault "clearly was a terrorist attack." Panetta said the investigation to pinpoint which terrorist groups were involved is ongoing.

Panetta and Dempsey also reported that the joint U.S./Afghan patrols that had been suspended following a spike in "insider attacks" on American forces have been resumed, and that most U.S. and NATO forces have returned to normal operations alongside Afghan soldiers and police.

Panetta said the "insider attacks" were intended to undermine the trust built between U.S. and Afghan security forces.

Gen. Dempsey added: "The Taliban tried to split us apart and it won't work."

In an NBC News exclusive, Libya's President Mohammed Magarief tells NBC's Ann Curry that no mastermind has been arrested in the attack on the US Consulate in Benghazi but that he believes it was a pre-planned act of terrorism involving elements of al-Qaida.

(AP) ? Republican vice presidential nominee Paul Ryan criticized President Barack Obama on Wednesday over the protests in the Middle East, saying the region "looks like Tehran in 1979, but in about a dozen capitals throughout the world."

"You can turn on the TV and look and see how the Obama foreign policy is blowing up in our faces," Ryan told a crowd at a lawnmower-manufacturing facility in Fort Collins.

The Wisconsin congressman was referring to the 1979 Iranian revolution that led to the storming of the U.S. Embassy in Tehran and the 444-day hostage crisis that helped undermine President Jimmy Carter's administration.

Ryan continued to hammer Obama's foreign policy during a visit to Colorado Springs, home of the U.S. Air Force Academy and Fort Carson, and promised not to cut military spending. Earlier this year he voted in favor of automatic, across-the-board cuts in Pentagon spending in January as part of a bipartisan deficit-reduction agreement.

"We're going to rebuild this military and stop apologizing for the greatness of this country," he said.

Ryan said Obama is ignoring the mounting federal debt. He displayed slides showing the burden growing to more than double the size of the American economy in years to come and predicted that would wreck the country's financial health.

"This is the most predictable economic crisis we've ever had and the president is ducking," Ryan said. "He is kicking the can down the road."

A questioner in Fort Collins cited Republican candidate John McCain's debate performances in 2008 and asked Ryan whether presidential candidate Mitt Romney would be "forceful" in the upcoming presidential debates. Ryan said "absolutely" and added: "One little difference between then and now: President Obama has a record, and President Obama has a record and a string of broken promises."

MOORESTOWN, N.J. (CBS) - ?We were duped like everyone else,? said Moorestown Community House event coordinator Joan Brown.

The Moorestown Community House normally charges a $1,000 to $1,500 fee for a ballroom wedding. Lori Stilley of Delran had her wedding here in April of 2011 for just $400. Brown says they believed at the time they were helping a sick woman with limited funds.

?I recall her coming in with some friends,? Brown said.

She says Stilley?s friends told her ?that she had cancer and she needed to get married and she was going to pass away within days.?

Sensational host catering owner Henry Gosik says his sales people were told the same story when asked to cater the wedding.

?I was told she was terminally ill, was in stage four, was undergoing chemotherapy,? said Gosik, who also lent a helping hand.
?I don?t know the exact amount they paid us, but I know I discounted it 70 percent,? he said.

The two are among many conned by Stilley, according to the Burlington County Prosecutor who charged her Wednesday with soliciting thousands of dollars in donations while falsely claiming to be undergoing treatment of bladder cancer since February 2011. Officials say Stilley had never been treated for, or even diagnosed with cancer.

?I feel disgusted really, I feel kind of let down,? said Brown.

In hindsight, she says of Stilley:

?She had energy, so she didn?t seem sick to me and I remember thinking that, ?Gee I wonder how sick she is, she?s planning this wedding,?? said brown

?You took advantage of a company that makes money in catering, good for you. But your family and friends and your people in your community that reached out to you, that had a fundraiser for you. Shame on you,? said Gosik.

Stilley?s mother, Dottie Oppmann, who talked off camera said she believes her daughter had cancer and says she cared for her grandchildren when their mother was too sick to do so. Oppmann says she doesn?t know what her daughter?s prognosis is now.

Non-actuary Job at an Insurance Company - Actuarial Outpost

Difficult to know how to answer this one.

On the one hand, a potential employer may be less interested up front if you give them the impression your goal is a different one from the one you are applying for.

But some employers would also be supportive of this, and progressing to others areas might be a common part of company culture. I think it depends on the company, and if you could get someone on the board who works for the company to advise you, that might help.

I'm in your boat, and told my employer my 3-5 yr goal would be to work in actuarial. She was fine with that, and couldn't be happier to have someone with real Excel skills teach her analysts that use Excel all the time, and rather inefficiently. I know little about health insurance, so this experience is good background. In the end I might find that some other position presents reasonable advancement opportunities.

You can always work on the exams without telling your employer at all. With a Ph.D. you sound pretty smart, you should be able to blow through the first 4 in a year or two without too much expense to yourself, and before you know it you WILL be in an actuarial capacity, either at this company or elsewhere. Given the chance, make opportunities to get friendly with actuarial if at all possible, although that's probably easier than said if you don't have a regular business need to be over there.

Antivirus Software: Unreliable?

The antivirus software that we have paid for and long relied on to protect our information might not be effective. The technology is running a race with malware programs and malware is winning. More sophisticated and challenging to detect malware comes out every day and this is very concerning to those of us who access the Internet on a day-to-day bases.

Burned by Flame

The Technology Review story focuses on Flame, probably the most complicated instances of malware ever discovered. According to the story, Flame has been copying documents and making recordings of audio, keystrokes, network traffic and Skype calls and taking screenshots of all this activity from the computers it has corrupted. What?s the worst part? Flame has been doing this for at least two years, based on the Technology Review story. And during this time, not a single bit of security software discovered this notably clever bit of malware.

An Industry Under Siege

Wouldn?t it be nice if Flame was the only malware that could get by antivirus software? Unfortunately, this is not the case. There are quite a few that are more than difficult to detect and as soon as antivirus software gets upgraded, malware is developed that challenges it even more. This does not mean you ought not take all measures available to protect your computer, like keeping your antivirus software up to date. You ought to just be aware that there are viruses out there that may break through. Hopefully the antivirus industry will eventually catch up with the growth of viruses and malware.

Britain urged to investigate Trafigura scandal

ABIDJAN, Ivory Coast (AP) ? The British government is urged by Amnesty International and Greenpeace to investigate possible criminal charges against the multinational firm Trafigura, over the dumping of toxic waste in Ivory Coast that is blamed for several deaths and sickening thousands.

The 2006 waste disposal in Abidjan has come here to represent the arrogance of the western world toward the African continent.

A three-year-long investigation by Amnesty International and Greenpeace published Tuesday points to "clear evidence that at least part of the decision-making process on export of the waste from Europe and delivery to Abidjan emanated from London," making U.K. prosecutions feasible.

The report calls for the United Kingdom to undertake criminal investigations against Trafigura. It also urges Ivory Coast to review a 2007 decision that gave Trafigura immunity from prosecution on Ivorian soil, and to probe how compensation from an out-of-court settlement in the U.K. was allowed to be misappropriated.

Britain's government responded Tuesday, saying it would be inappropriate for the U.K. to launch an investigation because the vessel involved was not registered in the U.K. and the waste wasn't loaded in or originating from the U.K.

"We condemn incidents such as occurred in Abidjan where toxic waste was dumped, with such devastating effects on human life and the environment," a spokesman from the Department for Environment, Food and Rural Affairs said. "Controls are in place in the UK to help prevent such incidents occurring, including controls on ships waste and on the import and export of hazardous waste."

More than 100,000 people sought medical treatment in the first five months after the waste was dumped in Abidjan in 2006, according to Ivorian authorities. A national commission of inquiry reported 15 deaths, though an Ivorian court put that number at 17. Trafigura has disputed those figures, saying the waste could only have caused "low level flulike symptoms and anxiety."

The new report says the dead included a 6-month-old baby and an inmate at Abidjan's main prison said to be 12 or 13 years old. Waste had been dumped just a few meters from the prison's juvenile block.

Six years ago on a morning burned into the collective memory of this West African nation, Abidjan residents awoke to a smell that was a mixture of rotten eggs and gasoline fumes.

Overnight on Aug. 20, 2006, toxic waste from the ship Probo Koala had been dumped in at least 18 locations throughout the city, including near houses, schools and crops.

Before long, residents reported symptoms including nausea, respiratory problems and burning skin, and the lack of information on what was causing the smell and symptoms created panic.

The new report describes how Trafigura purchased large amounts of an unrefined gasoline called coker naphtha, then subjected it to a refining process known as "caustic washing," which is known to create hazardous waste. The caustic washing was initially carried out on land in the United Arab Emirates and Tunisia, but Tunisian authorities suspended the process in April 2006 after workers became ill, and the rest of the process was carried out at sea, according to the report.

The multinational attempted to offload the waste in Gibraltar, Malta, France and Italy without success, the report says. An agreement was then reached with a Dutch company to offload the waste in Amsterdam, but the company raised its price after tests showed the waste would require more specialized treatment than had originally been expected. After failing to offload the waste in Lagos, Nigeria, a Trafigura subsidiary arranged for it to be offloaded in Abidjan in August by Compagnie Tommy, a firm that had received its operational license the previous month.

Fabrice Gbangbo, 37, who lives near the open-air Akouedo dumpsite, the initial offloading point for the waste, described to the AP how he woke up the morning after the waste had been deposited to see large blisters forming on his skin.

"Everybody was panicking here," he said. "No one knew where the smell was coming from."

Although the case has received much attention, the new report contends that Trafigura's role in the dumping "has never been subject to a full court proceeding." It also says Trafigura has blocked attempts to obtain full information about the nature of the waste.

For example, Gbangbo said that without this information, residents of his village would never know if they were completely safe. "I don't know if I'm still affected because we never had a good medical analysis," he said. "We think we are OK, but maybe we're suffering inside. I don't know."

Responding to the report in a letter addressed to Amnesty Africa Director Audrey Gaughran, Trafigura said the report contains "significant inaccuracies and misrepresentations," but does not specify them.

"The report oversimplifies difficult legal issues, analyzes them based on ill-founded assumptions and draws selective conclusions which do not adequately reflect the complexity of the situation of the legal processes," reads the letter, signed by Eric de Turckheim, a member of Trafigura's supervisory board.

"Courts in five jurisdictions have reviewed different aspects of the incident, and decisions and settlements have been made. It is simply wrong to suggest that the issues have not had the right judicial scrutiny."

Trafigura agreed in February 2007 to pay roughly $200 million to Ivory Coast for compensation and clean-up. This was the same settlement that gave Trafigura immunity from prosecution in the country. However, it is unclear whether all victims deemed eligible by the government for compensation had received any money, said Amnesty's Gaughran, who added that the government's list of victims was likely incomplete.

An additional $45 million in compensation was paid by Trafigura as part of a 2009 settlement in a case brought in the U.K. by 30,000 victims, but the distribution process was corrupted when an organization falsely claiming to represent victims effectively robbed some 6,000 victims of the money they were due to receive.

Ivory Coast's Minister for African Integration Adama Bictogo resigned in May over his alleged role in the scandal, though a prosecutor said in July that charges would not be brought against him.

The letter from Trafigura says the apparent misappropriation of compensation payments was "regrettable," but that this was "entirely outside our control."

Gaughran said it was important for Ivory Coast to review past problems with compensation and to continue to distribute money to victims who were not able to access previous compensation schemes.

One of the main lessons of the case, she added, was how difficult it was to ensure accountability for actions taken in multiple countries, but she said it was important that Trafigura be held responsible. "We can't end up in the position that just because three or four countries are involved that somehow nobody can get to grips with the problem," she said.

Report: More fees, less choice for air travelers

(AP) ? Airline passengers can expect fewer carriers to choose from, fewer flights to smaller cities and more baggage and other fees as the industry continues to grapple with high fuel prices and a weak economy, according to a government report released Tuesday.

The airline industry is still in transition after a tumultuous decade in which bankruptcies and mergers cut the number of airlines accounting for the bulk of domestic flights in half, to just five: American, Delta, Southwest, United and US Airways, the report by the Department of Transportation's inspector general said. If US Airways and American ? which are in merger discussions ? were to combine, that would drop to four.

There are dozens of other airlines in the U.S., but collectively those smaller carriers account for less than 15 percent of total passenger traffic. Twelve years ago, there were ten major U.S. airlines accounting for 90 percent of domestic flights. But high fuel prices, the 2008 recession and a slow economic recovery have taken a toll, the report said.

In 2000, fuel costs were just 10 percent of airline operating expenses. Fuel costs peaked at 40 percent of expenses in 2008, outdistancing payroll as the airlines' biggest expense. Last year, fuel accounted for 35 percent of expenses.

Less competition has enabled airlines to try to offset higher costs by eliminating less profitable flights to smaller cities, the report said. Airlines cut the number of scheduled domestic flights by 14 percent between June 2007 and June 2012, the report said. As a result, flights have fewer empty seats and airlines have been able to increase fares, especially on short-haul flights.

Last year, the industry attempted 22 fare increases, of which 11 were successful, the report said. Airfare increases are considered successful if competitors also adopt an increase. If there's not widespread matching by other airlines, the result is usually a withdrawal of the original increase. So far this year airlines have attempted eight fare increases, four of which have been successful, the report said.

Since 2008, airlines have also supplemented their fares by charging a wide range of fees for services that in most cases used to be free. Baggage fees alone contributed $2.7 billion in added revenue to airlines last year. Besides fees for checked bags, at least two airlines ? Allegiant and Spirit ? now charge passengers for carry-on bags.

As a result of these trends, the industry in general has become profitable again after years of red ink. And having fewer flights has resulted in a drop in flight delays and cancellations.

"The good news is that the (carrier) consolidation and ancillary fee revenue stream have stabilized the airline industry," said Kevin Mitchell, chairman of the Business Travel Coalition, which represents corporate travel managers. "The bad news is airlines can disregard consumers' interests much more easily when there are fewer carriers."

John Heimlich, vice president and chief economist for Airlines for America, a trade association representing major airlines, said one reason airlines have cut back on flights is that more passengers traveling less than 700 miles are choosing other forms of transportation such as cut-rate intercity buses and Amtrak's higher-speed Acela trains in the Northeast. He said some people would also rather drive than hassle with security checks in the post-9/11 world.

"Airlines have been more cautious about avoiding a glut of seats in the marketplace relative to the demand, and such caution has helped the industry get back on more solid financial footing," Heimlich said.

Even though the month is quickly coming to a close it?s worth noting that September is? National Yoga Month.? Ironically, even though about 16 million people do yoga now, this fact keeps a low profile, preferring to be quietly noticed, rather than creating a lot of ballyhoo about itself.? How very like yoga to do that.

Now if you?ve been following this blog for more than a week, you probably realize that yoga has been part of the warp and weft of my life for about 20 years.? I discovered the practice while struggling to regain my health after a very serious illness.? More than just the personal benefits I gained from the practice, it took hold of me so completely that I began a whole second career sharing yoga with students as a teacher in the Kripalu tradition.

Yoga is and has been my anchor when life was most uncertain; the burr under my saddle when my actions didn?t match my belief; the physical metaphor for developing the strength, flexibility and balance I hoped to embrace every day.? And, just like the opening quote implies, yoga offered an opportunity for self-acceptance I?d not found anywhere or anytime before.

Everyone, including me, comes to yoga hoping to gain something from the experience.? Maybe they want to be healthier, less stressed, more flexible, or simply cure their aching backs. ? There are as many reasons as there are people taking class.

Probably for me, the most exciting part of what I do is teaching folks who are ?newbies? to the whole yoga thing.? Sometimes they share with me what brought them to sign up, sometimes I just look out over the room and sense the feeling that they are waiting for something to happen, some sought after change to come.

What IS my business is to reassure them without hesitation that, if practiced regularly, the yoga will guide them unerringly from where they are now, to where they need to go next.? Ironically, it?s not even essential that the practitioner know where that is ? the yoga seems to always know.

So there you have it ? my open ?love letter? to yoga, my companion over these many years.

True, yoga is not for everyone, and there are certainly other ways to bring together the body, mind and spirit in the union which defines yoga.? But, if you feel the least bit curious, I offer my invitation to be brave and try it.? There?s lots of different styles, and many personalities of teachers to chose from.? Do a little research and find something that calls to you.

I?ve always thought of the Fall, not January, as the beginning of the year.? It?s a great time to begin a new practice, or recommit to an existing one.

American Society Of Animal Science Releases Future Research ...

The American Society of Animal Science (ASAS) addresses animal research and animal-based food challenges in new Grand Challenges documents. The ASAS Grand Challenges focus on five important issues in animal agriculture:

Animal health: Healthy animals produce healthy products for human consumption. Animal health research also decreases the risk of animal diseases reaching the human population. Support for animal health research would improve disease resistance, disease prevention and animal productivity. Read this document

Climate change: Animal agriculture is one source of greenhouse gas emissions, but animal agriculture is also directly affected by shifting climates. Natural disasters, droughts and heat waves can harm animals and make animal feed scarce. A better understanding of climate change would keep animal agriculture economically and environmentally sustainable.

Food safety: New technologies and basic microbial research can help scientists detect pathogens in the food supply. Research into food safety can decrease chance of contamination on the farm and in the kitchen.

Global food security: The U.N.?s Food and Agriculture Organisation estimates that one in seven people suffers from chronic hunger. New research could improve the nutrient content in animal products, increase production efficiency and reduce food wastage along the supply chain.
Animal well-being: Animal scientists work to balance science-based, economically sustainable animal care with public concerns about animal welfare. Animal scientists must conduct transparent, proactive research into welfare issues like animal housing and human animal harvest.

The Grand Challenges documents are ASAS endorsed and advocated research priorities for the future of animal science. Analysis: Japan, China military conflict seen unlikely despite islets row

TOKYO (Reuters) - Hawkish Chinese commentators have urged Beijing to prepare for military conflict with Japan as tensions mount over disputed islands in the East China Sea, but most experts say chances the Asian rivals will decide to go to war are slim.

A bigger risk is the possibility that an unintended maritime clash results in deaths and boosts pressure for retaliation, but even then Tokyo and Beijing are expected to seek to manage the row before it becomes a full-blown military confrontation.

"That's the real risk - a maritime incident leading to a loss of life. If a Japanese or Chinese were killed, there would be a huge outpouring of nationalist sentiment," said Linda Jakobson, director of the East Asia Program at the Lowy Institute for International Policy in Sydney.

"But I still cannot seriously imagine it would lead to an attack on the other country. I do think rational minds would prevail," she said, adding economic retaliation was more likely.

A feud over the lonely islets in the East China Sea flared this month after Japan's government bought three of the islands from a private owner, triggering violent protests in China and threatening business between Asia's two biggest economies.

Adding to the tensions, China sent more than 10 government patrol vessels to waters near the islands, known as the Diaoyu in China and the Senkaku in Japan, while Japan beefed up its Coast Guard patrols. Chinese media said 1,000 fishing boats have set sail for the area, although none has been sighted close by.

Despite the diplomatic standoff and rising nationalist sentiment in China especially, experts agree neither Beijing nor Tokyo would intentionally escalate to a military confrontation what is already the worst crisis in bilateral ties in decades.

U.S. PRESSURE

"The chances of a military conflict are very, very slim because neither side wants to go down that path," said former People's Liberation Army officer, Xu Guangyu, now a senior consultant at a government-run think tank in Beijing.

Pressure from the United States, which repeated last week that the disputed isles were covered by a 1960 treaty obliging Washington to come to Japan's aid if it were attacked, is also working to restrain both sides, security experts said.

"I very seriously do not think any of the involved parties - Japan, China and including the United States because of its defense treaty (with Japan) - want to see a military conflict over this dispute," said the Lowy Institute's Jakobson.

"They don't want to risk it, they don't seek it and they do not intend to let it happen."

Still, the possibility of a clash at sea remains.

While the presence of the Chinese surveillance ships - none of which is a naval vessel - and Japan Coast Guard ships in the area might appear to set the stage for trouble, military experts said each side would try to steer clear of the other.

"The bad news is that China sent ships to the area. The good news is that they are official ships controlled by the government," said Narushige Michishita at the National Graduate Institute for Policy Studies in Tokyo.

"This is good news because they are not likely to engage in aggressive action because that would really exacerbate the situation and turn it into a major crisis," said Michishita.

The Chinese ships, he said, had another mission besides asserting China's claims to the islands and nearby waters.

"My guess is that some (Chinese) official patrol boats are there to watch out for fishing boats ... to stop them from making problems," Michishita said.

FISHING BOATS WILD CARD

Military specialists say the Chinese patrol vessels are well disciplined as are the Japan Coast Guard ships, while the two sides have grown accustomed to communicating.

"Both sides are ready, but both sides are very well under control," said a former senior Japanese military official.

What worries observers most is the risk that a boat carrying Chinese fishermen slips through or activists try to land, sparking clashes with Japan's Coast Guard that result in deaths - news of which would spread like wildfire on the Internet.

In 1996, a Hong Kong activist drowned in the nearby waters.

Diplomatic and economic relations chilled sharply in 2010 after Japan arrested a Chinese trawler captain whose boat collided with a Japan Coast Guard vessel. This time, tensions are already high and China is contending with a tricky once-in-a-decade leadership change while Japan's ruling party faces a probable drubbing in an election expected in months.

"Two rational governments of major countries would not intentionally decide to enter into a major war with each other over a few uninhabited rocks," said Denny Roy, an Asia security expert at the East-West Center in Hawaii.

"But unfortunately, you can arrive at war in ways other than that - through unintended escalation, in which both countries start out at a much lower level, but each of them think that they must respond to perceived provocation by the other side, both very strongly pushed into it by domestic pressure. That seems to be where we are now and it is difficult to see how countries can get out of that negative spiral."

Others, however, were more confident that an unplanned clash could be kept from escalating into military conflict.

"That's not really a major possibility, because there are still broad channels of communication between the two sides, and they would help prevent that happening. Both sides could still talk to each other," said former senior PLA officer Xu.

"Even before anything happened, you would also have the U.N Secretary General and others stepping in to ensure that the situation does not get out of control."
