Meredith Bagby: America Gets "D" on 2011 Report Card

As the year ends, students at Harvard University release a 2011 "report card" on America. The result -- you can probably guess -- is just short of harrowing.

Published by the Harvard Political Review, the premier undergraduate political rag on campus, and the American Education Foundation, "The Annual Report of the USA 2011" is a 70-plus-page tome, which analyzes the real state of the U.S. economy over the course of the past year. Written by Democrats and Republicans alike, the report seeks to be nonpartisan, clear, and most of all, understandable to an average citizen.

So how does America score this year? The U.S. gets a "D." Yikes. Now that's a report card I'd flush down the toilet before my mother saw. The reason for the low score includes the downgrade of American credit in August, a sluggish economy, the intractable U.S. debt problem and -- most of all -- the incessant political bickering which ensured that none of these problems were adequately addressed. While the grade "may seem harsh" -- especially given the economic crisis many European countries face -- they didn't "grade on a curve." A first for Harvard students.

This year, Americans watched as the national debt rose to over $15 trillion, nearly matching the GDP. A tumultuous Congress passed the Budget Control Act of 2011 to raise the debt ceiling on the condition that the federal government decreases future spending. Despite the last-minute compromise, Standard & Poor's downgraded the US credit ranking from an AAA to an AA+ immediately afterward, insinuating that the US is no longer the world's safest borrower. After three years of recession, the US failed to reign in federal spending and agree on a sustainable budget. This skyrocketing spending partially stemmed from the American Recovery and Reinvestment Act of 2009. The Recovery Act sought to allay unemployment during the recession with over $787 billion in stimulus funding. But this is only a small factor in the deficit equation. The 2010 budget allocated over $820 billion to healthcare, $847 billion to defense, nearly $750 billion to pensions, and $502 billion to welfare. Entitlement spending, such as Social Security and Medicare increase annually as rising medical costs and an aging population demand more from the system.

The Annual Report is contextually important as fight after fight ensues in Washington about how to rein in our debt and political contenders for 2012 offer solutions. The first step for taxpayers -- and voters -- however is to understand the complicated issues at hand. As taxpayers, we are all truly shareholders of the U.S. government. But while corporate stockholders receive annual reports at the end of the year to track their investments, we American citizens are kept in the dark. The Annual Report is flipping the light switch on.

As a publisher of the Annual Report through the American Education Foundation, what I find most harrowing is that Americans seem to have lost faith in their government to deal with any of these problems. Wagley and Raymon write, "Even before the Budget Wars, the American people harbored serious concerns about their legislators' ability to enact sustainable solutions. The Bank Bailout, though it has largely paid for itself, incited anger against hasty government action on behalf of Wall Street. The Bailout failed to halt the foreclosure crisis, stymie rocketing unemployment, or increase lending. As evidenced by the Occupy Wall Street movement, many Americans believe that the government is beholden to Wall Street and special interests. Meanwhile, President Obama's newly proposed American Jobs Act of 2011 attempts to relive the Recovery Act, which failed to stem unemployment and jumpstart the economy."

2011 is nearly over. It's likely that most Americans will agree with Harvard's report card: it wasn't one of our bests. The question remains whether we can make 2012 and beyond better. As the year ends and the excitement of a new year builds, here is hoping that we force our politicians to present us with real economic solutions during -- and vote accordingly. While an "A" is a long way off, most of us might settle for a B next year.

DoSomething.org's annual list ranks the 20 most charity-friendly stars.

Lady Gaga, Justin Bieber and George Clooney better have received something nice from Santa this year, because they certainly weren't on his naughty list. Those three toplined DoSomething.org's Top 20 Celebs Gone Good, the organization's annual roundup of the most charity-friendly stars in the business.

This is Gaga's second year in a row at the #1 spot. In 2011 she dedicated much of her time to putting an end to bullying and even started a new charitable organization called Born This Way. The "Marry The Night" singer did plenty more to help out those less fortunate in 2011, including auctioning off a nude sketch for charity and performing at the Bill Clinton Foundation fundraiser.

However, this was really Bieber's year to shine. He rocketed up DoSomething.org's list from #10 last year to #2 this year. It helps that Bieber donated some of his profits from his Christmas album, Under the Mistletoe, and his self-named perfume to various charitable organizations. Bieber also kept up his work with Pencils of Promise, a group that has built 41 schools in Laos, Nicaragua and Guatemala and was founded by his manager's brother. Rounding out the top five were Will and Jada Pinkett Smith and Leonardo DiCaprio. This was a year for celeb power couples, with Brad Pitt and Angelina Jolie clocking at #8, Ashton Kutcher and Demi Moore at #12 and newlyweds Blake Shelton and Miranda Lambert at #14. Other notable standouts this year were Demi Lovato and #10, Lea Michele making her charitable debut at #16, Daniel Radcliffe at #17, Miley Cyrus at #18 and Taylor Swift rounding out the list at #20. Junior dos Santos won't fight Frank Mir for revenge, predicts Lesnar has early advantage against Overeem

Revenge is best when you get it yourself.

Ultimate Fighting Championship (UFC) Heavyweight Champion Junior dos Santos has been giving his thoughts on the recent submission loss of his mentor, Antonio Rodrigo Nogueira, at the hands of former division champion Frank Mir at UFC 140 on Dec. 10, 2011.

Nogueira, who serves as "Cigano's" Brazilian jiu-jitsu instructor, has suffered two defeats at the hands of Mir -- via technical knockout at UFC 92 back in 2008 and, most recently, Mir broke "Minotauro's" arm after he refused to tap to a kimura at the aforementioned UFC 140 earlier this month.

With the submission victory, Mir became the first man to ever submit the jiu-jitsu black belt, to go along with being the first to ever stop "Big Nog" via strikes in their initial encounter.

However, don't expect the young champion to seek out a revenge fight for his friend.

Speaking to Tatame.com, Dos Santos says that should he ever get the opportunity to fight Mir, he won't do it to get revenge for Nogueira, but rather, would like to see "Minotauro" get revenge on his own.

"I just think it was a complicated fight for all Brazilians, mainly for us at Team Nogueira. He (Rodrigo) had the win in his hands and with Frank Mir knocked out in front of him, and, for some reason, he didn't keep punching him, he tried to fit a guillotine choke and Frank Mir was lucky enough to grab his arm, and grabbed the chance when he had one. The problem was that he broke Rodrigo's arm, and he has just recovered, and now he'll stay some time off. But we know it already; I know what it'll be the result of it: Rodrigo will come back and bring much joy to all of us. I don't need to revenge him. I guess there's no such thing; I guess he (Rodrigo) can do it himself. But I confess I have never picked out opponents and I won't, but if someday I fight Frank Mir, absolutely it'd be an interesting fight."

In a sense, "Cigano" has already obtained revenge for Nogueira once before. On Nov. 12, 2011, at the inaugural UFC on Fox 1 show, dos Santos knocked out Cain Velasquez in the first round to become the new UFC heavyweight champion. In the process, he avenged a previous loss of Nogueira to Velasquez, which he suffered at UFC 110 on Feb. 21, 2010, in "The Land Down Under."

A third fight between Mir and Nogueira is highly unlikely given the outcome of the previous two bouts. Even though dos Santos wouldn't mind a fight with Mir in the future, he has much bigger fish to fry in his first title defense.

Much, much bigger.

That's because "Cigano" will take on the winner of this weekend's (Dec. 30, 2011) colossal heavyweight clash at UFC 141 between Brock Lesnar and Alistair Overeem.

A match up that he believes can go either way:

"It's a tough fight for the both of them. I'm saying it'll be 50-50, but Brock has more chances on the beginning of the fight because he's more explosive and goes for it."

Dos Santos is currently rehabbing from successful knee surgery he had to repair a torn meniscus that he damaged prior to his title fight with Velasquez.

Should a fight between "Cigano" and Mir ever come to fruition, will the Brazilian bomber have better results than those of his mentor Nogueira? Does he stand a chance against the Lesnar-Overeem winner?

Proposed Guantanamo rule change sparks backlash

SAN JUAN, Puerto Rico (AP) ? The new commander of the Guantanamo Bay prison is seeking to impose significant changes to communications allowed between lawyers and prisoners facing war- crimes charges at the U.S. base in Cuba, The Associated Press has learned.

The proposed changes, contained in a 27-page draft order, have sparked a backlash from the Pentagon-appointed attorneys representing the five Guantanamo prisoners charged in the Sept. 11 attacks. They say the new rules would violate attorney-client privilege and legal ethics and deprive the prisoners of their constitutional right to counsel.

The order is still in draft form and has not yet been signed by the commander, a detention center spokeswoman, Navy Cmdr. Tamsen Reese, said Tuesday. She said the commander was not immediately available for an interview.

Lawyers for the Sept. 11 prisoners received the draft order from the commander, Navy rear Adm. David Woods, on Dec. 22 and were told to sign an agreement to abide by the rules within 48 hours.

Instead, they sent a written response contending that requiring them to abide by such rules in order to see their clients was illegal.

"This requirement, as a precursor to engaging in client communications, interferes with the attorney-client relationship, compels counsel to violate ethical obligations, and therefore renders it impossible for counsel to effectively represent our clients," they wrote, appealing for more time to review the proposed order.

The memo was signed by at least one member of each legal team representing the five prisoners, according to a military official who spoke on condition of anonymity because the document had not been publicly released.

The five prisoners accused of helping to organize the Sept. 11 case are expected to be arraigned at the base in 2012 in what would be the most high-profile U.S. war crimes tribunal since the World War II era. The five, including the self-proclaimed mastermind of the attacks, Khalid Sheikh Mohammed, are facing charges that include murder and could be sentenced to death if convicted.

The Sept. 11 trial has been delayed for years by legal challenges and a dispute between members of Congress and the White House over whether it should be held in a civilian court on the U.S. mainland or in a tribunal at Guantanamo. A dispute over communications rules between prisoners and their lawyers could add another delay.

The most significant disagreement is over the handling of legal communications, which are typically sent by courier from the defense lawyers, who are based in the Washington area, and the prisoners at the base on the southeastern corner of Cuba.

Under the new rules, a "privilege team," which would include Department of Defense and law enforcement officials, would conduct a security review of all communications to the prisoners, according to the memo. The lawyers say such a review is unnecessary, since they all have security clearances and know not to release classified information, and also overly intrusive.

They say it would be impossible for Woods to ensure that these officials do not share this information with the prosecution or others because the members of the team wouldn't be under his command.

The chief defense counsel of the military tribunals, Marine Corps. Col. Jeffrey Colwell, said he shares the concerns of the attorneys in the Sept. 11 case. He also objects to a provision in the new rules that would allow detainees to receive only letters from their lawyers and not any supporting documents such as legal motions or articles about their case.

"The government's interpretation is very restrictive," Colwell said.

Woods can change the rules because he has authority over the detention center, where the U.S. now holds 171 prisoners. The government has said that 30-60 of the prisoners could be charged before military tribunals and the new rules would only cover communications between those prisoners and their lawyers. A separate set of rules covers the rest.

Woods has not said publicly why he has proposed the new rules. In his draft order, he says the new rules he has proposed are motivated by his responsibility for "maintaining safety and security, as well as good order and discipline," at the prison.

This is not the first attempt by Woods, who took command Aug. 24, to tighten security at the prison.

In October, the admiral ordered a search of prisoner's cells and the plastic bins where they are allowed to keep personal papers such as mail from their lawyers or family mail sent to them through the Red Cross.

Navy Cmdr. Thomas Welsh, the senior legal official at the detention center, testified at a hearing in November that the inspections were intended to make sure prisoners did not improperly mix personal and legal mail, which are supposed to be kept in separate bins, and to make sure they didn't have any "incendiary" magazines or material that could pose a security threat.

The defense team for Abd al-Rahim al-Nashiri, the Guantanamo prisoner charged with orchestrating the attack on the USS Cole in 2000, faced a similar set of restrictions in November. A lawyer for al-Nashiri said they would also violate the attorney-client privilege and asked the military judge in that case to intervene. The judge directed prison staff to not read attorney letters to clients, but came before last week's broader order from Woods.

There is no judge yet in the Sept. 11 case and so those attorneys cannot yet ask a court to intervene.

Rick Kammen, a civilian attorney for al-Nashiri, said that his defense team also has concerns about the proposed new rules but has not yet decided how to respond. He said the new changes underscore the argument among many that the cases should be tried in the established civilian federal courts rather than military tribunals, where the rules have evolved in recent years.

"The rules keep changing. The landscape keeps changing daily," Kammen said.

China premier urges protection of farmers' rights (AP)

BEIJING ? Chinese Premier Wen Jiabao has urged officials to share profits from the development of rural land with the millions of farmers who have to give it up.

Wen's speech to officials at a work conference Tuesday comes a week after southern Chinese officials gave in to protesting villagers after a two-week standoff with police over a land dispute.

He says China can no longer sacrifice farmers' land rights for the sake of reducing the cost of urbanization and industrialization.

Last Wednesday, the village of Wukan called off protests that had driven out local officials after a provincial party official agreed to release detainees and return some confiscated land to farmers.

Land disputes cause tens of thousands of protests in China every year.

Why Is Value Investing Essential? - Stock Market

The roots of value investing date back to the 1930s and it is a price-driven discipline that seeks companies whose shares are selling at a discount to their true, or intrinsic, value.

Investors that are growth-oriented focus on firms whose earnings are growing at a rapid pace which is a quality that makes them highly sought after but for value investors, what they seek are companies that are temporarily out of favor. Their shares may be depressed due to factors ranging from company-specific issues to shifting investor sentiment, poor economic conditions, cyclical trends or an overall market decline. Sometimes they?re being ignored by the market for no good reason.

Over the past 25 years, performance, diversification and risk control are the three factors that have amply made the case for the value style of investing.

Performance. First and foremost, value investing as a strategy has done well over time, rewarding investors with strong risk-adjusted performance. This has actually been true over the past quarter-century.

Additionally, it is important to note that dividends have and continue to be a significant component of the stock market?s total returns ? and particularly those of value stocks.

Diversification. Over time, value and growth stocks have tended to move in different cycles. Tending to outperform value shares and vice versa are growth stocks when they are in favor. That knowledge encourages many investors to construct portfolios employing both value and growth strategies, helping to ensure that they have equity investment with the potential to perform in changing market environments.

More to the point, the value strategy has more than held its own against its growth counterpart. In recent years, the outperformance of value has been particularly pronounced.

Risk control. By their nature, generally tending to be less volatile than their growth counterparts are value stocks. Value firms are better positioned to withstand market declines as well because their shares are typically selling at depressed prices. But normally having higher earning expectations that are built into their prices are shares of growth companies which means that they are subject to wider price swings as those expectations change.

Solyndra docs: Politics infused energy programs

Linda Sterio remembers the excitement when President Obama arrived at Solyndra last year and described how his administration's financial support for the plant was helping create hundreds of jobs. The company's prospects appeared unlimited as Solyndra executives described the backlog of orders for its solar panels.

Then came the August morning when Sterio heard a newscaster announce that more than a thousand Solyndra employees were out of work. Only recently did she learn that, within the Obama administration, the company's potential collapse had long been discussed.

"It's not about the people; it's politics," said Sterio, who remains jobless and at risk of losing her home. "We all feel betrayed."

Since the failure of the company, Obama's entire $80 billion clean-

technology program has begun to look like a political liability for an administration about to enter a bruising reelection campaign.

Meant to create jobs and cut reliance on foreign oil, Obama's green-technology program was infused with politics at every level, The Washington Post found in an analysis of thousands of memos, company records and internal e-mails. Political considerations were raised repeatedly by company investors, Energy Department bureaucrats and White House officials.

The records, some previously unreported, show that when warned that financial disaster might lie ahead, the administration remained steadfast in its support for Solyndra.

The documents reviewed by The Post, which began examining the clean-technology program a year ago, provide a detailed look inside the day-to-day workings of the upper levels of the Obama administration. They also give an unprecedented glimpse into high-level maneuvering by politically connected clean-technology investors.

They show that as Solyndra tottered, officials discussed the political fallout from its troubles, the "optics" in Washington and the impact that the company's failure could have on the president's prospects for a second term. Rarely, if ever, was there discussion of the impact that Solyndra's collapse would have on laid-off workers or on the development of clean-energy technology.

"What's so troubling is that politics seems to be the dominant factor," said Ryan Alexander, president of Taxpayers for Common Sense, a nonpartisan watchdog group. "They're not talking about what the taxpayers are losing; they're not talking about the failure of the technology, whether we bet on the wrong horse. What they are talking about is 'How are we going to manage this politically?' "

The administration, which excluded lobbyists from policymaking positions, gave easy access to venture capitalists with stakes in some of the companies backed by the administration, the records show. Many of those investors had given to Obama's 2008 campaign. Some took jobs in the administration and helped manage the clean-energy program.

Documents show that senior officials pushed career bureaucrats to rush their decision on the loan so Vice President Biden could announce it during a trip to California. The records do not establish that anyone pressured the Energy Department to approve the Solyndra loan to benefit political contributors, but they suggest that there was an unwavering focus on promoting Solyndra and clean energy. Officials with the company and the administration have said that nothing untoward occurred and that the loan was granted on its merits.

Most documents that have been made public in connection with a congressional investigation relate to the period after the loan was granted. The process began in the George W. Bush administration but resulted in the first loan in the program being granted under Obama. As a result, many factors that led to Solyndra winning a half-billion-dollar federal loan remain unknown.

White House officials said that all key records regarding Solyndra's loan approval have been released.

Officials acknowledged that some of the records provide an unvarnished view that they might have preferred to keep private -- such as a senior energy adviser's reference to a conference call about Solyndra as a "[expletive] show," or a company investor writing that when Solyndra was mentioned in a meeting, Biden's office "about had an orgasm."

Officials said those unflattering disclosures reinforce their position that they are not hiding their actions and that, despite the blemishes, nothing suggests political considerations affected the original decision to extend the loan to Solyndra. They stressed that the administration disregarded advice to avoid political problems by replacing senior Energy Department managers and moving to abort Obama's visit to Solyndra.

"Everything disclosed . . . affirms what we said on day one: This was a merit-based decision made by expert staffers at the Department of Energy," White House spokesman Eric Schultz said in a statement.

Officials said that concern for workers was reflected in the administration's decision to allow Solyndra employees to receive aid under a program for workers displaced by foreign competition.

"When Solyndra's liquidity crisis became clear, the Department of Energy underwent a robust effort to find a viable path forward for the company," the White House's prepared statement said. "This administration is one that will fiercely fight to protect jobs even when it's not the popular thing to do."

Star power in D.C.

Like most presidential appearances, Obama's May 2010 stop at Solyndra's headquarters was closely managed political theater.

Obama's handlers had lengthy e-mail discussions about how solar panels should be displayed (from a robotic arm, it was decided). They cautioned the company's chief executive against wearing a suit (he opted for an open-neck shirt and black slacks) and asked another executive to wear a hard hat and white smock. They instructed blue-collar employees to wear everyday work clothes, to preserve what they called "the construction-worker feel."

White House e-mails suggest that the original idea for "POTUS involvement" originated with then-Chief of Staff Rahm Emanuel. Emanuel, now mayor of Chicago, did not respond to a request for comment from The Post.

Well beyond the details of the factory photo op, raw political considerations surfaced repeatedly in conversations among many in the administration.

Just two days before the visit, Obama fundraiser Steve Westly warned senior presidential adviser Valerie Jarrett that an appearance could be problematic. Westly, an investment fund manager with stakes in green-energy companies, said he was speaking for a number of Obama supporters in asking the president to postpone the visit because Solyndra's financial prospects were dim and the company's failure could generate negative media attention.

"The president should be careful about unrealistic/optimistic forecasts that could haunt him in the next 18 months if Solyndra hits the wall," Westly wrote. Westly did not respond to a request for comment from The Post.

Similar concerns arose repeatedly among officials inside the White House. One staffer at the Office of Management and Budget suggested to a colleague that the visit could "prove embarrassing to the administration in the not too distant future." Even Ron Klain, Biden's chief of staff, acknowledged "risk" in the trip.

But administration officials ultimately waved off the jitters, after assurances from Energy Department officials that their policy was sound and that Solyndra's troubles would be fleeting. After Obama's trip, the administration hung a photo from his visit on a wall in the West Wing, to underscore good things to come.

Solyndra's financial picture did not improve, however, and by year's end the company was crumbling. Its investors pitched bailout plans, seeking help from what a Solyndra executive referred to as the "Bank of Washington" -- his apparent term for U.S. taxpayers. The Energy Department rebuffed the plans, at least initially.

In late 2010, Solyndra board member Steve Mitchell told his associates that Energy Department officials had conceded that additional financing was necessary yet said in private meetings that they lacked the political muscle to deliver it. "The DOE really thinks politically before it thinks economically," Mitchell concluded. A spokesman for Mitchell said he would have no comment for this article. An Energy Department spokesman said that all decisions regarding the loan were based on merit.

Solyndra eventually realized that it had to lay off workers to stay afloat -- no small step for a company that the president had backed to create jobs in a recession. But records indicate that the Energy Department urged company officials to delay the move until after the contentious November 2010 midterm elections, which imperiled Democratic control of Congress.

At least 38 dead in Haitian shipwreck off Cuba (Reuters)

HAVANA (Reuters) ? At least 38 people died on Saturday when a boat carrying Haitian migrants sunk off the coast of Guantanamo province in far eastern Cuban, Cuban television reported.

It said 87 people, including seven women, were rescued after Cuban civil defense forces spotted the boat 100 meters off Punta Maisi, which is about 600 miles southeast of Havana.

There were no details on possible cause of the accident or the destination of the boat, but search and rescue efforts were still underway, the report said.

The dead included 21 men and 17 women, it said.

Investing with appropriate speed | Lance Wiggs

So you are, or are not an Angel. But as commenters pointed out from that post there are several ways to invest, and we don?t want to scare off potential investors.?I got some flack for being a bit too negative, and sure, perhaps I was a bit harsh. Everyone starting a business is looking for money at some stage, and anyone wanting to get involved and help with funding is welcome.

As the number of investors, founders and investments grows in New Zealand, we can start to lift our understanding of what great looks like. We should expect and demand certain behaviours from both founders and investors, and we should expect us all to get better over time.

We get better, as an industry, by doing more. It takes all types of models to?figure?out the better approaches, and there is no one true way.

Investors that invest and founders that start and grow companies are all learning. They are learning through their mistakes and their successes, and they are learning by investing or starting up multiple companies. Some of the success stories, and Xero is a classic example, rely on years of founder and investor experience before the company is even formed. Others come out of the blue, but the founders and investors come back for more (Hyperfactory, 42 Below). It?s all welcome, and we are progressively gaining building momentum.

What founders want.

Founders are looking for investors with the right balance of speed, expertise and funds. As an investor you need at least one of these attributes, and great investors have all three.

What investors want

Investors are looking for great returns on their investment and an easy time with it. They often also want to help. They need to be confident on the potential of the business, the quality of the team and the price of the investment. Founders who are realistic in their assessment of the business potential and valuation will encourage investors to come on board more quickly. As one investor I know says, founders should ?value the cash?.

Being fast

Investors and founders want to make decisions quickly yet with confidence, which means founders need to be able to provide the right level of information, and investors require the right level of professional and legal negotiation, due diligence and contracting. There?s a common language involved, and as everyone gets more experience it becomes easier to make deals happen.

The ?right? level of preparation and rigour for investors and founders depends on the size of the investment, which also dictates the expected speed. The handy table below, and yours may vary, shows what I believe are the sweet spots for investment sizes and the expected time to complete a deal.

The green boxes are the target times for each investment bucket. Investing at these speeds is a healthy rate which allows founders to maintain momentum while investors can perform an appropriate amount of investigation, negotiation, due diligence and contracting. The orange section is worryingly slow, yellow unrealistic for most and the red section is far too painful for the founder, who should reassess the potential of the business and look elsewhere for funds.

The amount and time period dictates the amount of work done by each party to raise the money. Just how much work and what should be done, I intend to discuss, by investment size, in a series of forthcoming posts.

Saying no fast.

Speed of decision making and execution is an imperative for founders, as the fund raising process takes an?extraordinary?amount of time and effort away from the core business. While it might seem right as an investor to keep asking for more information, often the kindest thing to do when uncertain is to say no very quickly. Most investors will have defined investment criteria, which they and founders use as an initial filter. They are good tools to help to say no.

While the process will vary depending on deal size, there are always things each party can do to make things faster, or slower. From a founder perspective it?s smart to talk to previous people who have succesfully or unsuccessfully dealt with the investor. From an investor?s perspective it?s smart to make rapid decisions based on defined criteria, and to have simple processes. This might mean investing less than you really want to, or using tranches to ensure the company meets certain targets along the way. Other times it is going to mean cutting a few corners and taking a punt on the team ? and that?s what a lot of this is about at the earlier stages.

Overall if you have lots of money to offer then you can afford to take your time and ponder the investment. If you are are throwing around only a few thousand each time then you?ll be expected to move very quickly. There is more?uncertainty, but less to lose and higher potential percentage returns.

Expertise

Investors with industry expertise should be able to assess your product and strategy more quickly than their peers, for a given investment size. They might get it wrong (founders will see this as them saying ?no?), but they should offer good advice along the way. They are preferred partners and and other investors involved will look to them for their lead.

Investors with less expertise are actually ok, provided they are bringing something to the table, which is usually huge amounts of funds or credibility. We should not expect those funds to appear quickly, and should realise that a significant amount of industry education may be required.

End note

For the record ? I don?t regard myself as an angel as I?m not a HNW individual. The money I invest is generally all of the free cash I have earned from consulting, and has ranged from a few hundred dollars (with sweat) to a few hundred thousand per investment. I?ve averaged about 3 investments or companies a year for the last 3 years, and prefer to hold the investments, hopefully forever.

I tend to understand companies and industries very quickly and can make rapid decisions, but I don?t have the necessary ?war chest.

I?m also ?improving? on my ability to judge teams, as I tend to think everyone is awesome. That?s largely true as over the years I?ve learned that almost everyone is somehow held back from realising their true potential, and I?ve seen that start-ups have a way of bringing out the best in people.

Former UFC fighter Browning is big news in Thailand, finally turns himself in

Junie Brownie has been out of the UFC's hair for a while, but he's been back in the news over the last week. Apparently, it's a big deal in Thailand.

The former reality star on Season 8 of "The Ultimate Fighter" got into a big brouhaha at a bar in Phuket on Dec. 13. He fled the hospital where he was being treated for injuries, been missing ever since and the Thai papers are all over the story.

Police have mounted a Phuket-wide hunt for an American man who started one brawl in a Phuket bar then continued it in the emergency treatment ward at Patong Hospital. Police have named the suspect they wish to interview as Allen Browning, 26, a Thai boxer who fled into the night on Sunday in Patong and has not been seen since.

Earlier in the night, Mr Browning allegedly was seen beating up on an expat woman in a bar in Patak Road, Karon. He also lashed out at Thai female bar staff when they tried to intervene, police said.

Four other tourists from Australia and the US also attempted to intervene but Mr Browning lashed out at them, too, police said.

UPDATE: Browning finally showed up at the police station and turned himself in according to Phuketwan.com.

Fightlinker discovered that Menzies was also in trouble with the law earlier this year during a flight from Sydney to Darwin.

Sydney man Simon Wilson Menzies, 31, was drunk and angry when he told the female cabin crew manager on a flight this week that he could "bring the plane down if he wanted."

Menzies said: "I'm half muslim, half Aboriginal and everyone else is a white [expletive]. I could [expletive] blow up the plane."

[...] The court heard Menzies was on Jetstar flight JQ81 from Brisbane to Darwin on Tuesday com when he became abusive after being refused a fourth beer.

The court heard he was refused service because he continued to be rowdy despite repeated warnings.

After he was refused service Menzies, who is 190cm and solidly built, stood over the cabin crew manager and told her to get the captain.

"Send the captain I will [expletive] smash him I'm the biggest guy on the plane," he said.

None of this comes as much of a shock with Browning. He was nearly kicked off TUF 8 several times for violent outbursts. He survived and was even given two more fights with the promotion.

In 2009, Browning was taken to a Las Vegas area hospital after what was reported to be a failed suicide attempt. He compounded his issue by allegedly attacking a female nurse at the hospital. The UFC immediately released him from his contract. He's gone 1-4 since his stint with the promotion and last fought in August. Frankly, right now fighting is the least of his problems.

Hands-On With The 4Moms Origami Stroller

When I first saw the 4moms Origami stroller, I knew it would be a hit. It's a robotic stroller that unfolds like the Autobots getting ready to roll out and has one of the nicest interfaces I've ever seen on a stroller (which is saying a lot). Why did it make me so excited? Well, first this stroller will beat the pants off any of those feature-rich Stokkes or Buzzes out there. Pull this thing out on the playground and you are the true Ninja Parent. Bugaboo? Whatever. My kid is riding Optimus Prime. I'm pleased to report that the buggy is as cool as it looks on video. The one-handed operation is seamless and incredibly satisfying and the fun LCD readout - complete with trip meter, battery level, and external temperature sensor - is just icing on the cake.

Off the Bench: 'Tebow' the dog busts drug smuggler

For the past month or so, Denver Broncos quarterback Tim Tebow continues to amaze the world with his late-game heroics and it seems that it has rubbed off on even dogs named ?Tebow?.

Yesterday, an Orlando?Metropolitan Bureau of Investigation dog named ?Tebow? (not pictured) busted a drug smuggler who was trying to smuggle cocaine into Florida:

A Puerto Rican man is facing a federal drug charge for his alleged role in trying to smuggle a kilo of cocaine into the country via Orlando International Airport in Florida.

The plot was disrupted when a drug detection canine named ?Tebow? alerted to the ?odor of illegal narcotics? coming from a suitcase that Weslie Morales, 20, picked up off a luggage carousel. The suitcase had been checked on an AirTran flight from San Juan by a ?Juan Garcia,? who subsequently did not get on the plane.

Morales was taken into custody by police and eventually released on $25,000 bail. For the dog named ?Tebow?, he continues to roam the Orlando International Airport and will continue his hunt for criminals.

Review: OnLive Mobilized: How cloud gaming works on cell carriers ...


This holiday season, mobile gamers will get a chance to do something they?ve never been able to do: play console games on smartphones and tablets.

Last week OnLive ? the cloud-gaming company which streams games rather than playing them natively ? released an app for Android (the iOS update is still pending approval from Apple) for use with smartphones and tablets. The mobile service functions much like how OnLive streams high-quality games-on-demand to desktop computers and laptops. But now the service has been tuned to work with Wi-Fi or 4G-connected mobile devices, which typically have much less capability and bandwidth to run a high-quality game.

Users can play a total 24 games with touch-controls alone, or the entire library of OnLive?s 186 games with a new Bluetooth-enabled controller, all on select Android smartphones or tablets. And at some point, users will be able to play on the iOS devices as well.

I?ve spent the last week testing the OnLive service across Los Angeles on all four major cell providers: Verizon, AT&T, Sprint, and T-Mobile, on each of their respective networks (Verizon on LTE/CDMA, AT&T on 4G and 3G, Sprint on 4G and CDMA, and T-Mobile on 4G and 2G). For the purposes of this article, 4G will signify HSDPA/HSPA+, and all 3G networks will be branded 3G. OnLive did not run on networks slower than 3G. Tests were also done on various Wi-Fi networks, since the now-ubiquitous nature of OnLive will allow users to enjoy free Wi-Fi gaming on their phones and tablets outside of the home.

I did the tests in two ways: while stationary and while driving (up to highway speeds). Stationary tests include using OnLive in different locations with different signal strengths, from one bar to the maximum number of bars (which differs between carriers and phone models). Phones and tablets tested includes the following:

  • HTC Vivid (AT&T)
  • HTC Rezound (Verizon)
  • LG Marquee (Sprint, 3G)
  • Motorola Droid Bionic (Verizon)
  • Samsung Galaxy S II (AT&T)
  • Samsung Epic 4G Touch (Sprint)
  • T-Mobile myTouch
  • T-Mobile myTouch Q
  • Samsung Galaxy Tab Wi-Fi (original, 7?)
  • Samsung Galaxy Tab 10.1 (Verizon LTE)

While OnLive only recommends select Android devices (and all iOS 5 devices once the app is available), in my tests the only requirement for any Android phone to work is a standard 4G antenna. Reports of certain phones not working have come up, but the app is available to all Android phone owners and works on the overwhelming majority of devices. According to OnLive CEO Steve Perlman, every phone handles decompression of the video signal differently, and only the recommended devices listed here have specific algorithms that OnLive has developed for optimal results.

?We use a different compression algorithm for different networks,? Perlman added, which results in slightly different results on all cell carriers. However, to ensure the best quality of game play, ?the compression algorithm changes every 4 milliseconds.? Every phone and every network acts differently, so this method stabilizes the signal across all phones and carriers. Finally, using the new Wireless Controller does not affect data speeds unless, according to Perlman, users connect multiple controllers to a single device.

I tested with three games specifically, though bounced on and off of others to make sure they worked just fine. The three were Mini Ninjas, Darksiders, and Unreal Tournament 3. Mini Ninjas and Darksiders are both titles that use virtual gamepads to play, and require no external controller. The former is a slow-paced arcade action game, while the latter is a medium-paced action/adventure title. UT3 is a fast-paced first person shooter that requires an external controller, and is the most difficult game to play through OnLive because of just how fast the game is, even using a wired connection.

A game like UT3 is extremely stressful for cloud gaming because milliseconds matter. A fast gamer will be able to tell when they click the mouse button if the trigger pulled immediately or not. Darksiders and Mini Ninjas are both easily playable over Wi-Fi with no perceptual slowdown whatsoever.

Here?s are the results of my testing per carrier:

Verizon ? Yes for LTE, No for CDMA

LTE networks are the fastest available today, with speeds ranging from 20 megabits per second (Mb/sec) to 60 megabits per second. OnLive requires only 1 Mb/sec to run, though recommends at least 5Mb/sec. On Verizon?s LTE network, average download and upload rates far surpassed OnLive?s requirement, and gaming quality over Verizon?s LTE network is superb. On the HTC Rezound, Motorola Droid Bionic, Samsung Galaxy Tab 10.1, and all other devices used with an LTE hotspot, the quality of games played was on par with high-speed home Wi-Fi.

With Verizon?s LTE, it didn?t matter if games were played while stationary or driving. Speeds while traveling had no noticeable impact on game play, though there were occasional stalls when driving. This is presumably due to jumping between cell towers, though Perlman told me that LTE networks are highly efficient, and there are many possible reasons for game play stalling abruptly, such as the signal bouncing around a building.

However, over Verizon?s LTE, OnLive was both playable and enjoyable, both with and without a controller. In my testing it never dropped a signal and only momentarily paused. The visual quality is excellent; video compression is smooth and almost impossible to see. Gameplay is extremely low-latency. Button presses are instantly read and, even with the occasional sputter, there is never any lag or a drop in quality. Even with a poor signal, LTE provides a high-quality gaming experience. I actually had more success over LTE in UT3 than over my home Wi-Fi, which seems absurd. Then again LTE in some areas locally is 5x as fast as my home internet.

Because Verizon?s LTE network is still fairly limited, when devices go out of range they switch over to the CDMA network, which is significantly slower. Using all of the Verizon handsets on CDMA is, except under perfect conditions (with a great connection and not moving), unplayable. CDMA doesn?t have the bandwidth capacity to really support streaming gameplay, mostly due to slow upload speeds. When in a good location with a strong connection, it?s possible to play games, but the video quality is very poor, and button presses can and often do lag.

Case in point, I played Darksiders while in the car driving on a freeway. The play experience was fine; smooth, quick, with only occasional sputters. But as soon as I lost the LTE signal, the game stalled for 5-10 seconds, and OnLive?s system kicked in and paused the game to wait for a better signal. Because Darksiders relies on checkpoints or saves, I lost some data, but was able to resume the game without concern later on.

AT&T ? Yes

Though AT&T?s LTE is not yet available in Los Angeles, 4G is. 4G is available on a small number of handsets, including all AT&T devices listed above, as well as the iPhone 4S. Most older US-based GSM phones do not support 4G, though utilizing the network does not require any new technology. European handsets have used the technology for over three years.

Over 4G OnLive is both playable and enjoyable. It doesn?t match the fluidity and visual acuity of LTE, but for game play that?s a moot point. Because 4G required only minimal change to AT&T?s current infrastructure, the network is universal nationwide: if you have a 3G connection, then you have 4G too. When Verizon phones when out of range of LTE, AT&T models continued playing without experiencing any lag or stalling.

Both stationary and when in motion, 4G on AT&T proved to have good to great quality for OnLive gaming. Video quality is very good, there is minimal lag, and the overall experience is low-latency. While it?s not quite as good as on Verizon?s LTE network, AT&T with 4G is the only carrier that I can recommend playing games through OnLive for car rides consistently, with a 4G-ready device. However, fast-paced games like UT3 showed some strain, mostly because of the amount of upstream bandwidth required for all of the button presses. Considering UT3 is one of just a handful of FPS titles currently available through OnLive, this slowness isn?t as big a concern as it may seem. Then again, pulling the trigger 50 times and only getting 45 shots is a problem, especially if you?re playing against friends online.

On 3G, just like with Verizon?s CDMA, the quality is exponentially worse, and it isn?t playable except with a good connection and not moving. AT&T is the only network where it was actually difficult to find areas with one or two bars, or generally poor reception. There are holes in the network, but they are generally very small and limited to canyons and rural roads, by the coast. In general, with poor reception OnLive will pause game play until the phone/tablet picks up a stronger signal.

AT&T, however, is also the only carrier that had could not connect to OnLive?s servers 25 percent of the time. This is likely due to data overloads at local cell towers, because it only occurred during high-peak times and only in certain locations. I found no evidence of this on any other service provider.

Protesters clashed with military police in central Cairo on Friday after rumors spread that an anti-government activist was detained at a sit-in and badly beaten, in the worst violence since the start of Egypt's first free election in decades.

Police fired in the air after dawn to try to disperse around 300 demonstrators who said they were angered by images posted online of the man - named as Abboudi Ibrahim - being supported by a crowd, his face badly bruised and eyes swollen and shut.

The fighting continued and, by mid-morning, the area around the cabinet office and parliament was strewn with rubble as soldiers and men in plainclothes threw stones from the roofs of state buildings down on protesters, who hurled back rocks. Continue reading.

Olympus ex-CEO attacks Japan investors as comeback bid struggles (Reuters)

TOKYO (Reuters) ? The whistleblower in Japan's Olympus Corp scandal, ex-CEO Michael Woodford, blasted Japanese shareholders on Thursday for failing to stand up for him, amid signs that domestic and foreign investors are split over his campaign to be reinstated.

Woodford, an Englishman who was a rare foreign CEO in Japan, went public with his concerns over crooked accounting at Olympus after his dismissal in October, leading to the uncovering of a $1.7 billion fraud that has left the company badly weakened.

He is now lobbying shareholders of the maker of cameras and medical equipment to support his reinstatement and replace the disgraced board with a new team that he is assembling.

"We saw a shameful state of the company's finances yesterday, but not one Japanese shareholder stood up and said publicly 'Mr Woodford is right, thank you Mr Woodford', anything, a total, an utter silence," Woodford said, a day after Olympus released its restated accounts on Wednesday.

His comeback campaign has highlighted the contrasting opinions of foreign and Japanese shareholders on the future leadership of Olympus, which has been found to have carried on a $1.7 billion fraud to hide investment losses for 13 years.

At least three big foreign shareholders have backed Woodford's bid to return to the company where he spent three decades working his way up from salesman to CEO. But not one Japanese shareholder or lender has openly supported him since he blew the whistle, leaving him clearly frustrated.

Woodford also launched an emotional attack on the firm's current Japanese boss.

"Should that man be the president and custodian of one of Japan's iconic companies?" he said of Olympus President Shuichi Takayama, one of the directors who had voted unanimously to sack him after he had queried the firm's dubious book-keeping.

"How dare he!" Woodford added, calling Takayama's handling of the whole affair "Machiavellian."

Woodford also said he had discussed refinancing options for Olympus with private equity firms and investment banks, and also voiced concerns that Takayama was planning to raise money by placing new shares with a third party.

That would dilute the stakes of existing owners and weaken their hand in a proxy battle between Woodford and whoever the existing board chooses as its next CEO candidate.

"It would dilute the existing shareholders, so then I could not win a proxy fight," he said.

The existing board, led by Takayama, has said he and fellow directors will resign soon, to make way for a new board to be elected by shareholders at a meeting in March or April, and that the board wants to choose its successors before it quits.

It has set up an external panel to advise on board candidates and other management issues.

Takayama even suggested on Thursday the board would consider Woodford as a candidate for his old job, but few analysts gave the gesture any credence given the hostility between the pair.

Takayama, currently the most senior executive after several resignations since Woodford's departure, said he had no plans to meet Woodford, who some major Japanese shareholders and lenders privately oppose, according to a banking source.

"As of now, I have no plans to meet," he said.

Woodford says the board is discredited and has no right to choose its successors, and on Thursday expressed anger at signs that not all of the incumbent board would resign.

He is assembling his own team of candidates for a new board with himself at the helm.

NEED FOR FRESH CAPITAL OR TIE-UPS

Woodford also went public with a plea to meet the head of Sumitomo Mitsui Banking Corp (SMBC), the main lender to Olympus, a possible sign that he was having trouble getting access.

"My representatives have asked for a formal meeting with SMBC. I hope they at least give me the courtesy of listening to me," he said. The bank, which is the core banking unit of Sumitomo Mitsui Financial Group, said it had not received the request and declined comment.

The next CEO and board of Olympus face major challenges, starting with a need to repair the once-proud firm's balance sheet, which was revealed on Wednesday to be $1.1 billion weaker than had been previously disclosed in its fraudulent accounts.

Olympus shares slumped 20 percent on Thursday, with investors now concerned it might need to merge, sell assets or raise fresh capital.

Takayama said on Thursday the company was considering capital and operational tie-ups, among other options, to relieve the pressure on its balance sheet, which was shown to have a very thin layer of equity remaining after the restatements.

Olympus forecast its troubled camera business will make a loss in the current financial year, but said unit sales had risen 15 percent in the six months to September 30 from the same period a year earlier.

The firm, whose main income earner is its very profitable endoscope business, avoided automatic delisting from the Tokyo Stock Exchange by meeting Wednesday's deadline for producing its overdue second-quarter accounts, giving some initial relief to investors.

However, the 92-year-old firm can still be delisted if the exchange believes the accounting deceit was sufficiently grave.

Woodford said he favored private equity or a rights issue over a strategic alliance, which would rob Olympus of its independence. But rights issues, where existing shareholders can buy more shares on a pro-rata basis, are rare in Japan.

Olympus has lost more than half its market value since it sacked Woodford and the scandal erupted. Two top Olympus executives have been found to have masterminded the scheme to cook the books, and both have since resigned.

Olympus has been dogged by rumors of bid interest from rivals, such as fellow endoscope makers Fujifilm and Hoya, or from private equity since the scandal broke.

The Tokyo exchange said after the announcements that it was keeping Olympus on its watchlist for possible delisting.

Survey: 1 in 4 US women victims of severe violence

(AP) ? It's a startling number: 1 in 4 women surveyed by the government say they were violently attacked by their husbands or boyfriends.

Experts in domestic violence don't find it too surprising, although some aspects of the survey may have led to higher numbers than are sometimes reported.

Even so, a government official who oversaw the research called the results "astounding."

"It's the first time we've had this kind of estimate" on the prevalence of intimate partner violence, said Linda Degutis of the centers for Disease Control and Prevention.

The survey, released by the CDC Wednesday, marks the beginning of a new annual project to look at how many women say they've been abused.

One expert called the new report's estimate on rape and attempted rape "extremely high" ? with 1 in 5 women saying they were victims. About half of those cases involved intimate partners. No documentation was sought to verify the women's claims, which were made anonymously.

But advocates say the new rape numbers are plausible.

"It's a major problem that often is under-estimated and over-looked," said Linda James, director of health for Futures Without Violence, a San Francisco-based organization that advocates against domestic abuse.

The CDC report is based on a randomized telephone survey of about 9,000 women.

Among the findings:

? As many as 29 million women say they have suffered severe and frightening physical violence from a boyfriend, spouse or other intimate partner. That includes being choked, beaten, stabbed, shot, punched, slammed against something or hurt by hair-pulling.

? That number grows to 36 million if slapping, pushing and shoving are counted.

? Almost half of the women who reported rape or attempted rape said it happened when they were 17 or younger.

Several of the CDC numbers are higher than those of other sources. For example, the CDC study suggests that 1.3 million women have suffered rape, attempted rape or had sex forced on them in the previous year. That statistic is more than seven times greater than what was reported by a Department of Justice household survey conducted last year.

There may be several reasons for the differences, including how the surveys were done, who chose to participate and how "rape" and other types of assault were defined or interpreted, said Shannan Catalano, a statistician with the Bureau of Justice Statistics.
